How to request client healthcare records from the practice

Wellspring Counseling and Education, PLLC (the “Practice”) is committed to protecting your privacy. The Practice is required by federal law to maintain the privacy of Protected Health Information (“PHI”), which is information that identifies or could be used to identify you. Additional information can be found i in the Notice of Privacy Practices provided to and signed by all clients located in the practice’s Electronic Health Records (EHR) system, which explains the Practice’s legal duties and privacy practices and your rights regarding PHI that we collect and maintain.

YOUR RIGHT TO REQUEST HEALTHCARE RECORDS
Your rights inspect and copy PHI is explained below.
• You can ask for an electronic or paper copy of PHI. The Practice may charge you a reasonable fee.
• The Practice may deny your request if it believes the disclosure will endanger your life or another person’s life. You may have a right to have this decision reviewed.

The following text of Section 181.103 describes how to file a consumer complaint with the Office of Attorney General’s Consumer Protection webpage:

Sec. 181.103. CONSUMER INFORMATION WEBSITE. The attorney general shall maintain an Internet website that provides:(1) information concerning a consumer’s privacy rights regarding protected health information under federal and state law;(2) a list of the state agencies, including the department, the Texas Medical Board, and the Texas Department of Insurance, that regulate covered entities in this state and the types of entities each agency regulates;(3) detailed information regarding each agency’s complaint enforcement process; and(4) contact information, including the address of the agency’s Internet website, for each agency listed under Subdivision (2) for reporting a violation of this chapter.
